Easement Exhibits & Legal Descriptions

SURVEY DOCUMENTATION FOR DEFINED PROPERTY RIGHTS.

An easement exhibit and corresponding legal description define the surveyed location, dimensions, area, and limits of land identified for access, utilities, drainage, construction, right-of-way, or another stated purpose.

The Easement Area, Described and Shown.

The legal description sets out the easement limits in metes-and-bounds form. The graphic exhibit maps those limits against the verified property boundary and current record information. These documents are typically attached to a separately prepared easement instrument.

How the Work Is Prepared

From Records and Fieldwork to the Final Deliverable.

Eagle reviews the current deed or plat of record, available title and project information, and the location criteria supplied by the project team. The work then moves through boundary field verification, easement calculations, document preparation, and RPLS review.

Record and Project ReviewReview the current deed or plat of record, available title information, plans, proposed route or limits, and any standards supplied by the receiving party.
Boundary Field VerificationLocate and evaluate the controlling boundary evidence and monumentation needed to position the easement accurately.
Exhibit, Description and RPLS ReviewCalculate the easement geometry, prepare the matching graphic exhibit and metes-and-bounds legal description, and complete professional review under a Texas Registered Professional Land Surveyor.
Roles and Responsibilities

Where the Survey Ends and the Easement Agreement Begins.

The survey documents and the easement instrument serve different purposes.

Eagle Defines the Location

  • Verifies the controlling property boundary in the field.
  • Applies the route, width, and limits supplied by the project team.
  • Calculates the easement geometry.
  • Prepares the graphic exhibit and legal description under Texas RPLS oversight.

The Easement Instrument Establishes the Rights

  • Identifies the parties and the intended purpose.
  • Establishes who may use the area and under what conditions.
  • Addresses access, maintenance, restrictions, duration, termination, and other legal terms.
  • Is prepared and approved separately by the parties and their legal or title professionals.

The survey documents identify where the easement applies. They do not independently create the easement or determine the parties' legal rights.

Frequently Asked Questions

Questions Clients Ask Before Ordering.

Provide the current deed or plat of record, a title commitment if available, the proposed route, width, or limits, the intended purpose, relevant plans or CAD files, receiving-party standards, and the requested schedule. Eagle will review the materials and identify anything else needed for the scope.

The property owner, engineer, utility, municipality, attorney, or other authorized project representative provides the intended purpose and location criteria. Eagle applies that direction to the verified property boundary and prepares the survey deliverable.

Yes. A development may need separate access, utility, drainage, temporary construction, right-of-way, or other easements. Whether they are prepared as separate instruments or coordinated within a larger package depends on the receiving party and recording requirements.

The RPLS evaluates the available deeds, plats, monumentation, occupation, prior surveys, and other relevant evidence. Additional research, fieldwork, or project-team coordination may be necessary before the easement geometry can be finalized.

Often, yes. A receiving entity may require specific title blocks, certification language, file formats, naming conventions, geometry standards, review steps, or submittal procedures. Providing those standards early helps Eagle incorporate them into the scope and production process.

The schedule depends on record availability, site access, boundary complexity, the number and length of the easements, project revisions, and any receiving-party review. Eagle confirms the anticipated schedule after reviewing the property information and proposed limits.

Eagle can prepare a revised exhibit and legal description when the surveyed limits need to be changed or clarified. Revising, releasing, or abandoning the legal rights requires a separate instrument prepared and approved by the appropriate parties and their legal or title professionals.

Discuss Your Easement Requirements.

Send the property information, proposed limits, applicable plans, and receiving-party requirements. Eagle will review the materials and confirm the survey scope and anticipated schedule.
