These terms govern your use of the Eagle Surveying website and the information, forms, and downloads it provides. They do not replace the written agreement that governs any surveying or Reality Capture engagement. Please read them before using the website. They apply to every visitor and to anyone who submits information through the website's forms.

Our Privacy Policy explains how we collect, use, and share personal information in connection with the website. If you do not agree to these terms, please do not use the website.
Eagle Surveying, LLC ("Eagle Surveying," "we," "us") may update these terms from time to time. The effective date at the top of this page shows when they were last revised, and continued use of the website after a change means you accept the revised terms.
The website describes our land surveying and Reality Capture services and shows examples of our work. Service descriptions, project summaries, photographs, orthomosaics, point clouds, models, and articles are provided for general information. Surveys, legal descriptions, and other project documents displayed on the website are examples of work prepared for particular projects. Publication on the website does not authorize reliance on those examples for any property, design, construction, financing, or transaction decision. Website content does not provide a title opinion, engineering opinion, or professional advice for your particular circumstances.
Only project deliverables issued by Eagle Surveying under a written engagement may be relied on by the intended recipients, for the purposes and subject to the scope and limitations of that engagement. Deliverables are signed and sealed where required by applicable law. Project names shown on the website may be project or end user names; they do not by themselves indicate a direct client relationship.
We work to keep the website accurate and current, but we do not warrant that any information on it is complete, correct, or up to date, and we may change it at any time without notice.
Submitting a form, requesting an estimate, or asking to schedule a meeting through the website does not create a contract, an engagement, or a client relationship. Pricing, scope, schedule, and deliverables are confirmed only in a written proposal or agreement signed by Eagle Surveying. Any estimate we provide in response to a website request is preliminary and subject to confirmation of the site, the scope, and the available records.
Information you send through the website should be accurate and complete. Files you upload, such as plans, plats, or exhibits, remain the property of their respective owners. By uploading them, you confirm that you have the right to share them and grant us permission to use them to evaluate and respond to your request.
Eagle Surveying, LLC is a Texas registered surveying firm, TBPELS Firm #10194177, regulated by the Texas Board of Professional Engineers and Land Surveyors (pels.texas.gov). Surveying services are performed in Texas under the responsible charge of a Registered Professional Land Surveyor. Selected Reality Capture assignments may be supported outside Texas where the requested service does not require a license we do not hold, applicable jurisdictional requirements allow the work, and we have confirmed the assignment in writing.
Flight operations are conducted under FAA Part 107 by pilots holding FAA Remote Pilot Certificates. Aerial collection is subject to applicable FAA airspace, operating restrictions, authorization requirements, weather, access, and site conditions. Where an assignment requires them, qualifying NDAA Compliant | Blue UAS Approved aircraft and sensor configurations are available; the availability of any platform for a specific project is confirmed in writing at the time of engagement.
Aerial thermal imagery, 360-degree site documentation, and construction progress documentation are data-capture and visual documentation services. Eagle Surveying does not diagnose building, equipment, or site conditions, does not certify construction progress or pay applications, and does not determine contractual responsibility. Those determinations are made by the qualified professionals and parties responsible for the project.
The Make a Payment link on the website takes you to SwipeSimple, a third-party payment processor, and your use of that service is governed by its terms and privacy policy. The amount you owe, the due date, and any dispute about an invoice are governed by your invoice and the written agreement for your engagement, not by these terms. Please confirm the amount and the invoice reference before submitting a payment.
Submitting an application through the Careers page does not create an offer of employment or an employment relationship. You confirm that the information and documents you submit are accurate and yours to share. Eagle Surveying is an equal opportunity employer and considers applicants without regard to any characteristic protected by law.
The website and its content, including text, photographs, video, graphics, orthomosaics, point clouds, models, page layouts, and code, are owned by Eagle Surveying or its licensors and are protected by copyright and other intellectual property laws. The Eagle Surveying name and eagle logo are trademarks of Eagle Surveying, LLC. Client, project, and brand names that appear on the website belong to their respective owners.
You may view the website and print or save pages for your own reference in evaluating our services. You may not copy, reproduce, republish, scrape, distribute, modify, or create derivative works from any part of the website, or use any content for a commercial purpose, without our prior written permission.
You agree not to: interfere with the operation or security of the website; use automated tools to harvest content or data, other than search engines indexing public pages; attempt to gain unauthorized access to any part of the website or its systems; upload files that contain malware or that you do not have the right to share; submit false, misleading, or unlawful information; or use the website in any way that violates applicable law.
The website links to and embeds services from other companies, including social media platforms, Google review pages and maps, video hosting, the SwipeSimple payment service, and the websites of community organizations we support. We do not control those sites or services and are not responsible for their content, availability, or privacy practices. A link does not mean we endorse the linked site.
The website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Eagle Surveying disclaims all warranties, express or implied, regarding the website and its content, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components. Nothing in this section limits the professional standards that apply to services performed under a written engagement.
To the fullest extent permitted by applicable law, Eagle Surveying and its members, managers, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, or business, arising from your use of or inability to use the website or from your reliance on any content on it, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to the website will not exceed one hundred dollars ($100), except where applicable law does not permit that limitation. This section applies to the website only and does not limit any liability that may arise under a written engagement agreement. Nothing in this section excludes or limits liability that cannot lawfully be excluded or limited.
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Eagle Surveying and its members, managers, employees, and agents from third party claims, losses, liabilities, and reasonable expenses, including attorneys' fees, but only to the extent caused by your misuse of the website, your violation of these terms, or your submission of content or files that are unlawful or infringe or violate another person's rights. This obligation does not apply to the extent a claim results from Eagle Surveying's negligence or willful misconduct.
These terms are governed by the laws of the State of Texas without regard to its conflict of law rules. Any dispute arising from these terms or your use of the website will be brought exclusively in the state courts located in Denton County, Texas, or, when federal subject matter jurisdiction exists, in the United States District Court for the Eastern District of Texas, Sherman Division. You consent to personal jurisdiction and venue in those courts.
If any provision of these terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of it. These terms are the entire agreement between you and Eagle Surveying regarding your use of the website. They do not modify any written engagement agreement, proposal, or invoice.
